Bharat me mahilao ke liye 1961 me Maternity Benefit Act, 1961 ki sthapna hui thi. Yah law India me har state me lagu hota hai. Koi bhi Dukan, Company, Factory ya Fir koi anay sansthan jisme 10 se jyada worker kam krte ho un par yah kanoon lagu hota hai. Avkash leni vali mahila ke liye jaruri hai ki vo 12 mahino se company me kam kar rhi ho or sath me pichle 80 dino se vo company me aa rhi ho. 2016 me Women and Child Development Minister Maneka Gandhi ke kahe anusar private company me Ministry of Labour ne Maternity leave ka time 12 weeks se lekar 26 weeks yani 84 dino se 182 din kar diya hai.

Maternity leave ke doaran sabse phle fayda to yhi ki es doran garbhavati mahila ki koi bhi payment nhi katati hai. Company ke dwara puri payment di jaygi. Bhut si companiya es doran pregnant orat ko Medical insurance bhi deti hai yah sab company ki policy par nirbhar karta hai.
Bhagwan kisi ki sath aisa na kar lekin fir bhi pregnancy ke doran agr kisi mahila ki marityu ho jati hai us doran Maternity Benefit Act se milne wala fayde yani ki payment ke rupye garbhvati mahila ke nomini ko milege.
How to apply for Maternity Leave ?

Maternity leave lene ke liye bachha paida hone se karib 3 mahine phle apply krna chahiye. Jyadatar companiya vase to 6 weeks childe birth se phle or 6 weeks childe birth ke bad ke liye chooti deti hai. Maternity Leave lene ke liye sabse phli bat to yhi hai ki aapke pas pregnancy proof hona jaruri hai. Pregnancy proof ke liye apko civil surgeon se certificate banwana hota hai. Agr ham govt. hospital se ye certificate banwate hai to yah jyada effective hota hai.
Medical certificate banwane ke bad ab apko apni company or office me Maternity Leave ke liye apply krna hoga. Apply krne ke liye aap apni company se form le skti hai ya fir apne pas ke court se Maternity Benefit Office se ye form le skti hai. Form me apko apne bare me puri jankari deni hogi jaise ki apne job kab join ki thi, kitne dino se aap regural job pe aa rhi ho, apna nomini etiyadi jankari.

Every woman employee, whether employed directly or through a contractor, who has actually worked in the establishment for a period of at least 80 days during the 12 months immediately preceding the date of her expected delivery, is entitled to receive maternity benefit.
Sir meri wife Bihar government m job krti h us ko join kye hoye 4month 15days ho gya h kya us ko metarnity leave mil sakti hai.
Hanji mil skti esme koi dikkt nhi hai…..

I am applicable for maternity paid leave or not?? because in this company I completed yet only 6month and I want to take leave from September.
They told me that its not our company policy. if you want leave then without any pay I will be able to give 5month leave
those compnies which have more than 10 worker that companies complessry for give meternity leave. and of course you are applicable for this leave if they don’t give you paid leave than you will go to court againt company
Its really helpful, but I want to know more information is that, I join private company on January 2016. Now I am pragenent and delivery will be on mid November. and now I am still working in my company, So I will get maternity paid leave benefit or not? because my company told me that I’ll not get paid leave benefit.
fist of all ask the resoan why they don’t give you paid leave benefit and the replay. as per rule pragenent woman get maternity benefit before or after 3 months delivery
